ℹ️ Living Wills / Advance Decisions — Legal background

A Living Will (formally an Advance Decision to Refuse Treatment) lets you state which life-sustaining treatments you refuse if you lose mental capacity. When properly made, it is legally binding on doctors under the Mental Capacity Act 2005.

  • Must be signed and witnessed for refusal of life-sustaining treatment
  • Doctors MUST follow a valid ADRT — it overrides family wishes
  • An ADRT does not authorise euthanasia or assisted dying
  • Separate from an LPA — they work together
  • Review regularly — circumstances may change
