ℹ️ Affidavits — Legal background

An affidavit is a written statement confirmed on oath. It is used in court proceedings (as evidence), probate applications, statutory declarations, and various administrative processes. Making a false statement in an affidavit constitutes perjury.

  • Must be sworn/affirmed before an authorised person (solicitor, commissioner for oaths, notary)
  • Sworn on the Bible or by affirmation (for those who object to religious oath)
  • False statement = perjury — criminal offence
  • For court: check specific court requirements for format and content
  • Statutory Declaration: alternative to affidavit for non-court purposes
