ℹ️ Prenuptial Agreements in England & Wales — Legal background

Prenuptial agreements are not automatically binding in England and Wales but are given significant weight by courts following Radmacher v Granatino [2010]. Both parties must have legal advice, full financial disclosure, and sign at least 28 days before the wedding.

  • Not automatically binding — court retains discretion
  • Radmacher: courts will uphold unless unfair or unforeseen circumstances
  • Both parties must have independent legal advice
  • Must be signed at least 28 days before wedding
  • Full financial disclosure is essential — concealment = unenforceable
