When two or more people rent together as joint tenants, they are each individually responsible for the full rent. A house share agreement supplements the tenancy agreement and governs the relationship between housemates — rent splits, bills, behaviour, and exit arrangements.
- Joint tenants: each person is liable for ALL the rent — not just their share
- One joint tenant can serve notice on behalf of all (Hammersmith v Monk 1992)
- House share agreement is not a tenancy — it's a contract between housemates
- If one person leaves, the remaining tenants may still be liable for full rent
- Consider whether all names should be on the tenancy agreement
