ℹ️ Equipment Hire Agreements — Legal background

Equipment hire agreements must clearly establish who is responsible for damage, loss, or theft during the hire period. The hirer takes possession but the owner retains title. Consumer hire is regulated by the Consumer Credit Act 1974 if the term is over 3 months.

  • Hirer is responsible for damage or loss during hire period (unless agreed otherwise)
  • Consumer hire over 3 months: Consumer Credit Act 1974 may apply
  • Equipment should be inspected on delivery and return — condition report essential
  • Insurance: check whether hirer's own insurance covers hired equipment
  • Force majeure: breakdown of equipment through no fault of hirer
