ℹ️ Disciplinary Letters & the ACAS Code — Legal background

The ACAS Code of Practice on Disciplinary and Grievance Procedures sets out minimum standards. Failing to follow it does not make a dismissal automatically unfair, but tribunals can uplift compensation by up to 25%.

  • Employer must investigate before any disciplinary action
  • Employee has right to be accompanied at any hearing
  • Letter must state the complaint, outcome, and right of appeal
  • Warnings should state they are live for a fixed period
  • Dismissal should only follow full procedure in most cases
